The Services may include features to assist you in the generation of text, image or other content (such features, “Content Generating Features”). Content Generating Features include without limitation Squarespace AI and any other Squarespace features that are identified as being governed by these Content Generation Terms.
These Content Generation Terms, along with our Terms of Service and any policies or other legal terms referenced herein or therein, apply to your access to and use of Content Generating Features. These Content Generation Terms are incorporated by reference into our Terms of Service. Any capitalized terms (or lowercase terms specifically defined in our Terms of Service) not defined in these Content Generation Terms have the meanings set forth in our Terms of Service or Product Specific Terms. Except as otherwise expressly set forth in these Content Generation Terms, in the event of a conflict or inconsistency, the rest of the Agreement shall govern, followed by these Content Generation Terms. The Content Generating Features enable you to provide text or other User Content (“Input”) and receive text, images or other generated content (“Output”) in return. “Brand Identity” of a site means information about the style, tone, nature, industry, audience, target market, or other design or related elements of the site. Aspects of your Brand Identity may be provided by you, in which case, they are considered Input and owned by you in accordance with Section 3.2 below. Other aspects of your Brand Identity may be auto-generated on your behalf. Your Brand Identity may be used to adjust the returned Output to more accurately match your Brand Identity. Your use of Output is subject to Section 5 (Your Responsibilities) of these Content Generation Terms. If you add Output to Your Site, including in editor mode or a published version of Your Site, such Output is your User Content and is subject to the provisions relating to User Content in our Terms of Service.
2. Warning about Content Generating Features; Disclaimer
Artificial intelligence software which generates content is a new and emerging technology. Output may be inaccurate, strange, or not fit for use or purpose. Additionally, Output may not be unique, whether across multiple Squarespace users or other users of content generating software provided by AI Software Service Providers (as defined below). For example, if you and another user provide the same or similar Input, you and the other user may each receive the same or similar Output. Even if Output received by another user is the same as Output received by you, only Output received by you is your User Content, and similar Output received by the other user is their User Content. Accordingly, to the fullest extent permitted by applicable law, Squarespace makes no warranties, either express or implied, about any Output. Output is provided “as is” and “as available.” Squarespace also disclaims any warranties (whether express, implied or arising from statute), including all warranties of merchantability, fitness for a particular purpose, non-infringement, satisfactory quality, title, quiet enjoyment and any warranties arising out of course of dealing or trade usage. Squarespace makes no warranty or representation that the Services will: (a) be timely, uninterrupted, error-free or secure; (b) meet your requirements or expectations; (c) be free from viruses or other harmful components; or (d) that defects will be corrected. Additionally, Squarespace makes no warranty or representation that any Output may be registered as a copyrighted work. Use of Output is voluntary and strictly at your own risk. You are solely responsible for any activity on your Accounts, the content you create using our Services and the content you post to Your Site or otherwise publicly make available over the Internet via our Services. Please use your discretion before relying on, publishing or otherwise using Output. YOU ACCEPT AND AGREE THAT ANY USE OF OUTPUT IS AT YOUR OWN RISK AND YOU WILL NOT RELY ON ANY OUTPUT AS A SOLE SOURCE OF TRUTH OR FACTUAL INFORMATION OR AS A SUBSTITUTE FOR PROFESSIONAL ADVICE.
3. Derechos y Licencias
3.1. AI Software Service Providers. In addition to the license you grant to us under Section 2.2 of our Terms of Service, you also grant Squarespace (including our third party hosting providers acting on our behalf) a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable right and license to: (a) as necessary to provide you the Content Generating Features, transmit your Input to the third party service provider(s) providing us with artificial intelligence software services (each, an “AI Software Service Provider”) for the AI Software Service Providers to use in accordance with its terms and policies; and (b) enable AI Software Service Provider to use any Output they generate from your Input in accordance with its terms and policies.
3.2. Ownership of Input and Output. Subject to the provisions of these Content Generation Terms and notwithstanding any provision to the contrary in our Terms of Service, to the extent Output may be owned under applicable laws, as between you and Squarespace, you are the owner of all your Input and Output.
4. Sus responsabilidades
You are responsible for: (a) thoroughly reviewing all Output (including without limitation to verify its accuracy and reliability) before publishing, distributing, displaying or otherwise using such Output; (b) deciding whether to edit, remove and/or publish on Your Site or otherwise use Output; (c) ensuring that your Input, your Output, your use of the Content Generating Features and your use of Output complies with applicable laws; (d) ensuring that your Input and Output complies with these Content Generation Terms and our Terms of Service, Acceptable Use Policy and the rest of the Agreement. Subpart (c) in the foregoing sentence includes without limitation requirements under applicable law relating to marking, watermarking, notice/disclosure, metadata, and copyright management information.
5. Additional Restrictions on Use of the Content Generating Features
In addition to the restrictions on use of our Services in our Acceptable Use Policy, you may not use Content Generating Features in the following ways: (a) to mislead End Users or any others with access to the Output that such content was human-created; (b) to create Output which: (i) provides medical advice or includes information about diagnostic or treatment for a medical condition, or (ii) provides legal, financial (including tax and investment) or other professional or regulated advice; (c) to create or use Output to condone, enable, promote or commit any act: (i) of violence, (ii) that could result in death or personal injury, or (iii) which violates applicable law; (d) to avoid, bypass, remove, deactivate, impair, defeat, jailbreak, hack, reverse engineer or otherwise circumvent any technological or other measure that: (i) is intended to filter, restrict, moderate, control, limit, monitor or review Input or Output, (ii) is intended to improve, apply or implement security, safety, trust, ethical, bias mitigation or related controls, or (iii) is intended to reduce or mitigate harm, harmful Input or Output, or any prohibited activity set forth in Section 6 of our Acceptable Use Policy; (e) to attempt to do any of the activities in the preceding subpart (d); or (f) provide Input which constitutes personal information of yourself or anyone else, including without limitation name, email address or data concerning an individual’s race, ethnicity, nationality, health status, religious beliefs, gender identity or sexual orientation. For the avoidance of doubt, applicable law includes without limitation any law and regulation that prohibits or otherwise restricts the creation of certain types of content (in whole or in part), including Output, using artificial intelligence or automated means, and/or the publication or other dissemination thereof. For purposes of illustration, such content includes political or pornographic ‘deepfakes’ as such terms are defined by the applicable laws prohibiting or otherwise restricting such content.
6. AI Software Service Providers
The Output of the Content Generating Features is generated by artificial intelligence software provided by our AI Software Service Providers. More information on our AI Software Service Providers may be found here. If you use the Content Generating Features, your Input will be shared by Squarespace to the applicable AI Software Service Provider and your Output will be generated by the applicable AI Software Service Provider.
7. Modification
We may modify these Content Generation Terms from time to time, and will post the most current version on our site. If a modification meaningfully reduces your rights, we may notify you in accordance with the procedures set forth in our Terms of Service. By continuing to use or access any portion of the Content Generating Features after any modifications come into effect, you agree to be bound by the modified Content Generation Terms and price changes, if any. If you disagree with our changes, then you must stop using the Content Generating Features.
